Businesses Whose Main Activity Is Subject To Authorisation

Although other blogs mentions some companies whose establishment is subject to authorisation, in accordance with specific legislation, companies that will be engaged in certain fields of activity are also required to obtain authorisation. These fields of activity are scattered throughout the legislation. For example, in order to open a school in Turkey, the approval of the Ministry of National Education or the relevant directorate is required under the Regulation on Private Education Institutions. Foreign real and legal persons wishing to open an international school must obtain authorisation from the President of the Republic.

As another example, the permission of the Ministry of Health is required to open a hospital and the permission of the Ministry of National Defence is required to operate in the defence industry. 

In addition, in order to operate in different fields of activity, it may be necessary to obtain authorisation from some authorities in Turkey. As mentioned, since these issues are scattered in the legislation, it would be beneficial to benefit from professional assistance for the legal process to be followed after the main fields of activity of the company are determined. 

 

Obtaining Authorisation for the Products to be Sold

Turkish legislation requires authorisation from the competent authorities for the sale of certain products. Companies that produce these products in their country of residence and sell them in their own market must also have these authorisations in order to enter the Turkish market. 

For example, medical products (pharmaceuticals, surgical products, health technologies, etc.) require approval from the Ministry of Health and food supplements require approval from the Ministry of Agriculture. 

Since this type of examination should be carried out on a product basis, it is a safe way to avoid penalties and lawsuits that may arise later, by working with legal professionals and those who will be guided by them during the establishment of the company and regularly thereafter. 

 

Opening a Workplace in Turkey by Foreigners

The first condition for foreigners to open a workplace in Turkey is to obtain permission from the Ministry of Labour and Social Policies. If the foreigner wants to work on his/her own behalf and account in the workplace, an application must be made to the Ministry for a work permit after the establishment procedures of the workplace are completed. If the application is positive as a result of the examinations to be made by the Ministry, there is also a requirement to make a request from the relevant municipality in order for the foreigner to obtain a workplace opening and work licence.

 

Establishing a Company for Foreigners by a Lawyer

There is no requirement for foreigners to make a personal application to open a company in Turkey. Therefore, it is possible for foreigners to open a company in Turkey with the support of a lawyer to whom they have given the necessary authorisations in the power of attorney.
